Caleb Sawyer and James Albertson can testify more fully of said constable neglect. Taken 8.8.90 Phillipe Goss- his mark " To the Honorable deputy of the Court, the humble pettition of Cyprian Stevens humbly declaiireth to ye Honor that as to his neglect or remissness as it is soe presented to your Honor was no for mant of obedience to authority, neither was I confederat with said Crosslee being a person I never had aquaintance with but with all my hart have seased him as may be evidence to your honor by Mr Henry Willard and Joseph Walters, neither I hope can any person declare agains me that ever I was enemy to this our distressed Country but I hop has allways aproved myselfe redy to serve in all duty both Kang and Country acording to my best ability. I failed in this matter through ignorance. I have fayled. I humbly upon my kness by pardon hoping that this may soe warn me so that I may serve my King and your Honor under him with due obedience. So humbly begging a remitting of this sentance that I may go to my family to secure a living and bordering upon the wilderness and do upon the enemy of our estate which shall oblidge your humble pettitioner to pray for your honor peace and prosperity - CYPRIAN STEVENS " Joseph Waters and Henry Willard testified to the attempt to arrest Croslee and his escape as stated in Steven's return to the warrent. By the above it will be seen that Stevens gad been convicted and was in limbo. Another of his petitions is also found in Mddlesex Court files. "Most Honor how ever bad the matter may be presented to your honor by Philip Goss and others relating to Robert Crosslee as though I was one of his abettors as to any thing he has acted sinfully against God or man.. I never was nor had any familiar aquaintance with him and as to my remissness it was not in contempt to authority nor in disobedience to the laws of our King but myselfe spaking of the broyle ataht was at Philip Gosses before I heard of ye Honor Deputy Governor's warrent. I was informed that ye said Crosslee had been a privatteare who when afterwards I received the warrent and being informed by sum that a privattteare values no more to kill a man than a dog and his own words when he stood upon his gard menifester the same swaring that he would dye or kill before he would be taken. I would certaynly would have taken him as may apeare by the two men asisting. Could we have done it without hazard to life. I humbly by a cheritable instruction by you that are the ffather of our estate for I know that I have not only to give and account to you but to answer for what I have done before the great God. I humbly prey and at your Honor's feet for a reducement that I may go to my family not knowing the danger but the fare they are in which shall oblige your humble servant Oct 8 90." " Cyprian Stevens constable of Lancaster appearing in court and having fullfilled the warrrant according to ye order ofCourt referring to Robert Crosslee, he is dismissed paying cost " "Mr Cyprian Stevens his bill of costs about Robert Crosslee, Mr Henry Willard and Joseph Waters coming from Lancaster in attendance at your court four days. If to my attendace and imprisonment to my damage If to my pursueing of him and taking of him as ye marshalls deputy. Ye order of Court with my assistants Nathaniel Wilder and Joseph Waters Oct 8 90. Persuing of him to Dorchester the seising of him who made his escape and then I had three men besides myself to persue and seze him with Joseph Waters James Bird and Mr. John Bird". As for my attendances at this present adjournment of said court 3 lbs 17 pence. Allowed by the Court at Charlestown by adjornment Oct 13 1690 Not long after this Cyprian Steven's wife is named Ruth. His first wife Mary having died at date not found. I have not discovered the date of Steven;s death, He was living in 1714 Midlesex Registry X 242 9 Dec 1693. Cyprian and Ruth Stevens mortgaged to Philip Goss ( all that the house settuss ) This they reduced all excepy 5 acres June 10 1695. Cyprian Stevens settled upon Simon Stevens his son Dec. 9, 1714 " five acres bounded by Philip Gosses land east and the highway north and west and south by the other part of the lot" John and Mary Goss deeded to Simon Stevens 40 acres " a place known by the name of ye high pasture and was formerly laid out for the upland house lott and 1 st. div intervale lot of Mr. Joseph Lawlandson xxxxx westerly by a lott that formerly belonged to Richard Smith and now in possession of Cyprian Stevens" " and 5 acres bought of Cyprian Stevens by my late honored ffather Phillip Goss. Simon and Mary Stevens deeded to brother 20 acres on neck " formerly purchased of John Grazier and by him purchased of Joseph Houton Sr. "bounded northernly upon the lot of Joseph Wheelock which formerly belonged to James Atterson and south upon the lot of James Houghton. ----------------------------------------------------------------- From THE GENIALOGICAL DICTIONARY OF THE FIRST SETTLERS OF NEW ENGLAND by Savage. He is not sure if this Mary is from the first or third wife but dates ect. point to the third wife. Most important is that her father, Simon, had a Mary by his first wife so it doesn't seem probable that they would name two Marys although there are no dates for the first one. From the section on Indian children put to service where Indian children were put out as servants to English families. - I Boy to Cyprian Stevens of Rummy Marsh but late of Lancaster , a boy aged 6 years, son of Nohanet of Chobnakonkonon, the boy named Samuel. ----------------------------------------------------------------- From HISTORY OF THE TOWN OF MARLBOROUGH by Charles Hudson Cyprian Stevens came to this country in the company of Thomas about 1600. He married June 22, 1671 Mary daughter of Maj.
